Teen Cyclist Killed by SUV Driver on a Dark Road. Who is at Fault?
A teen has died after being struck by an SUV as he rode his bike west of Spring late Tuesday. According to Harris County deputies, the accident happened on Spring Cypress Road at Bonnie Sean Drive around 11:00 p.m. Investigators indicate that the 17-year-old apparently darted across the road and was hit by a Nissan Exterra. Harris County Sheriff’s deputies said that the road was dark and unlit and that the driver had no chance to stop in time in order to avoid the accident. The driver of the SUV stayed at the scene of the accident. No charges are expected to be filed in the case. The parents have a legal right to file a suit for the death of their son, but they will need to speak with a lawyer with experience. Not all accidents call for a civil case. In this instance, we would look at all the circumstances and advise the parents on what to do next. For example, if there was a history of bad accidents on this stretch of road, there could be a case for a negligence suit against the city.
