Speeding Car Hits Curve Wrong, Leading to Accident
A driver was injured and her passenger killed when their vehicle rolled multiple times in an accident on Fry Road northeast of Katy. Texas State Highway Patrol troopers report that the crash happened near Clay Road around 3 a.m. Thursday, morning. The driver of an Acura had apparently been driving above the speed limit, travelling northbound on Fry Road. The driver lost control of the vehicle when she failed to make a curve in the road. The car went into a ditch, and then became airborne. The car flew across Fry Road, landed in a field on the other side of the roadway, but not before rolling several times. A male passenger was partially ejected from the vehicle and died on impact at the scene of the crash. The female driver was sent to the hospital and is listed in stable condition. Troopers with the Texas Department of Public Safety say that the driver may face charges from the crash. The accident is still currently under investigation. Far too often in the state of Texas, deaths that are a direct result of traffic accidents can be attributed to reckless driving. Had just a bit more safety been applied on the part of the driver, these deaths may very well have been prevented. When accidents of this type occur, even if no legal charges are filed, there can still be civil suits for wrongful death. The legal definition of reckless driving of a motor vehicle is the “willful or wanton disregard for the safety of persons or property.” Things such a driving over the speed limit, improper passing, ignoring traffic signs or signals and failing to yield the right of way to other vehicles on the road can all be considered reckless driving. Of course under this same definition is driving while impaired by alcohol or other substances as well as distracted driving. If someone is injured or killed by a reckless driver, those accident victims or their families have every right to seek compensation for their loss.
