Houston Motorcycle Accident Lawyer

Houston Motorcycle Accident Lawyer

Motorcycle accidents can lead to very serious injuries, especially when involved with a car or truck. If you or someone you love has been involved in an accident while riding a motorcycle, it may be in your best interest to seek the advice of a Houston motorcycle accident lawyer. With the help of a legal professional, you may be able to seek financial compensation for the injuries suffered.

When an accident occurs, through no fault of your own, you shouldn’t be responsible for the injuries you sustain. Medical bills can become stressful, along with all the other emotions and expenses accompanying the accident. Your Houston, Texas motorcycle accident attorney can help to relieve unnecessary stress.

How a Houston Lawyer for Motorcycle Accident Cases can Help

The insurance company will start hounding you and shoving papers in your face. They want you to settle fast and for a lower amount than you deserve. You don’t have to take their bullying anymore. When you hire a motorcycle accident attorney in Houston, they will deal with the insurance company for you. Often, just the presence of an attorney will stop the insurance company from using their tricks to get you to settle for less than you deserve.

Your attorney will take all of their calls, investigate the accident completely, recreate the accident (if necessary), interview witnesses and do everything necessary to build a strong case. Once the insurance company understands you won’t be taken advantage of, your motorcycle accident lawyer in Houston can negotiate a fair settlement to cover your medical expenses, lost wages, other damages, pain and suffering.

What you should do before Contacting a Motorcycle Accident Lawyer in Houston

Sometimes, due to the severity of your injuries, the only thing you can do after an accident is let the medical professionals take you to the hospital and do their job. However, if you are lucky enough to walk away from the accident and you can, it’s advised that you do the following:

  • Collect names and addresses of any witnesses
  • Take pictures of the accident scene (remember your cell phone probably has a camera)
  • Answer all questions asked by law enforcement officials
  • Seek medical attention, even if you feel fine (documentation will help your case)
  • Document any time missed from work
  • Record all medical expenses resulting from the accident
  • DO NOT speak to anybody from the insurance company without first consulting with a Houston Motorcycle Accident Attorney

All of these steps will help to ensure your case goes as smoothly and as quickly as possible. A settlement is usually the first option and most insurance companies want to settle the claim as fast as possible. With proper legal representation, a fair settlement may be reached very quickly. You will also gain the protection of knowing whether your attorney thinks the settlement is enough.

Hiring the Right Motorcycle Accident Attorney in Houston Matters

If you just hire any personal injury attorney or the first one to contact you, it could lead to less compensation and trial may not be an option. If the law firm you hire cannot support a trail, no matter how long it takes, the insurance company will do everything they can to ensure the case ends up in court and takes as long as possible.

It may end up costing the insurance company less to take the case to trial, than it does to settle it out of court. If this is the case, even if they don’t believe they can win, they may force a trial because your attorney cannot afford it. However, with the right motorcycle accident attorney in Houston, this won’t be an issue.

Houston Car Accident News

Motorcycle Accident Ends in Death near Cypress Station

A motorcyclist has been killed in an accident near Cypress Station on Sunday afternoon.

According to the Harris County Sheriff’s Office, he driver of a Honda Odyssey was struck by another vehicle in the 4700 block of Louetta as he was turning from Bent Elm Drive when he failed to yield to oncoming traffic.

After being struck, the motorcyclist flew off of his vehicle and into the car’s windshield and landed on the roadway.

The motorcyclist has been identified as Jonathan Denmark. Ge was transported to Memorial Hermann Hospital by Life Flight helicopter. Denmark later died as the result of the injuries he sustained in the crash.

Motorcyclists face a number of hazards that other drivers do not face when on the road. According to the National Highway Transportation Safety Administration (NHTSA), 4,295 people were killed in motorcycle accidents in the United States 2014. In both 2007 and 2008, this figure went over 5,000 fatalities due to motorcycle accidents. Motorcycles are smaller and lighter than cars. Motorcycle riders are far more exposed to the elements and the risks of a road and suffer far greater injuries or even fatalities than those in passenger vehicles whenever they get into an accident.

Motorcyclists are generally safe drivers and m any take extra precautions in order to stay safe such as wearing a helmet and other protective gear and always checking their vehicle over for safety issues before setting out on the road. Even with these extra precautions, however, accidents can and do happen; sometimes with tragic results.

Motorcycle Accidents are More Deadly

A news report from April from local station KHOU describes a deadly motorcycle accident. Late at night, a group of motorcyclists were travelling along the North Freeway when one of the drivers lost control. He fell into the middle of the freeway, and one of his fellow riders accidentally drove over him. He might have survived this, but he wasn’t wearing a helmet. The victim died at the scene. Riding a motorcycle is a complex art. There are balance and control issues that must be attended to at every moment. Many bike riders take special training to learn how to use a motorcycle safely.

There’s a good reason for the extra training. 80% of all motorcycle accidents end up with the driver of the motorcycle having some sort of injury, and it’s far easier to be killed driving a motorcycle than in an enclosed vehicle. There’s no way to install normal safety features on a motorcycle that you’d see in a car. There are no air bags or seat belts. It only takes a slight bit of inattention from a motorcyclist for an accident to occur, and they’re 35 times more likely to die as a result of an accident than people in a passenger vehicle. Safety gear for a motorcyclist involves leather garments and a helmet.

Yet many motorcyclists refuse to wear them, for several reasons. Many motorcyclists view bike riding as an expression of freedom that they don’t want to see restricted by a helmet. Others say that helmets block their peripheral vision too much and will lead to further accidents. Helmet opponents believe that wearing one should be up to the individual biker and not be legislated. Instead, rider education and avoidance of unsafe situations are preferred.

Yet the statistics show that about a quarter of the fatal accidents on motorcycles could have been prevented if a helmet was properly worn. For car drivers, it’s very important to keep a careful eye for motorcycles, if only for your own protection. While you have much less of a chance to be hurt, you can be on the hook for medical fees if you are deemed to be at fault. A lot of drivers are careless about motorcycles, and this can be costly in both lives and money.

Motorcycle Chase Leads to a Crash

Officers from the Houston Police department were led by a motorcyclist through downtown Houston around midnight on Thursday night. A Houston Police Department spokesman said that the motorcyclist on a sport bike refused to pull over for a traffic violation at Crosstimbers. The biker instead got onto the freeway southbound, taking the Dallas Street exit into downtown. The motorcyclist hit a curb at Clay Street. The suspect was arrested at the scene. It is believed that the biker likely bolted because there were several warrants pending for his arrest. According to Texas Statute Section 38.0, the charge of evasion of arrest or detention is a crime.

The penalties for this can be raised from being a class A misdemeanor to that of a third class felony if it is proven that the defendant used a vehicle while evading arrest. When you first see a police vehicle behind you and it is obvious you are being stopped use your signal and get as far over to the right as safely as possible. Be sure to stop your vehicle out of the way of traffic as possible. Be sure to stay calm and be aware of your tone, the words that you use and keep your emotions in check. No one likes to be stopped by law enforcement, especially when you know you’ve been caught doing something wrong.

Accidents that are caused as a direct result of police chasing someone who is trying to evade arrest can be serious or even fatal. When a criminal is trying to escape and the police are in pursuit, there is often little thought of other innocent drivers or pedestrians. If you or a loved one has been seriously injured in an accident as a direct result of a police chase from someone trying to evade arrest, give our offices a call. Our attorneys are highly experienced legal representatives who specialize in accident cases.

A Motorcyclist Is Dragged After A Hit-And-Run Crash. The Driver Is Still At Large.

A motorcyclist is lucky to be alive after being in a hit-and-run crash and dragged for nearly a half a mile along the East Freeway in Houston on Tuesday night.

KHOU in Houston reports that on Tuesday, July 21st at 10:00 p.m., firefighters with Houston Fire and Rescue and officers from the Houston Police Department responded to reports of a motorcycle fire.  Emergency crews responded to the area around McCarty Drive in the 8000 block of the East Freeway.

Firefighters extinguished the motorcycle fire while police searched for the missing rider who was not in close proximity to the bike.   He was later found further down the freeway and transported by ambulance to the hospital for treatment. He is expected to make a full recovery. His identity had not been released by the time of the report.

Investigators say that the motorcyclist had been part of a group of riders.  The victim decided to go ahead of the other riders. He lost control of his motorcycle and crashed into a vehicle.

While the motorcyclist was still lying in the road, he and his bike were struck by a white pickup truck and dragged along the freeway.  The motorcycle and rider eventually broke free from the truck, but the driver did not stop.

Houston Police investigators say that the driver of the white pickup truck is still at large. Police are asking anyone who may have witnessed the incident or have any further information to contact Crime Stoppers of Houston at (713) 222-TIPS (8477).
